Man receives 11.5 years for Ehrenberg fires

Friday, February 5, 2010 9:15 AM MST

Eldon Ray Campbell, 26, of Ehrenberg, has been sentenced to 11.5 years in prison for his role in setting fires to unoccupied structures and wildlands in the Ehrenberg area. Judge Michael Burke in La Paz County Superior Court in Parker handed the sentence down Feb. 1.

Campbell was one of six persons who allegedly set fires in the Ehrenberg area. The others were Jacob Hicks, James Seaton, Joshua Hall, Joseph Hall and Fernando Lizarraga. Seaton, Hall, Hall and Lizarraga were firefighters with the Ehrenberg Volunteer Fire Department. They allegedly set the fires as a means of creating work for themselves.

Campbell was initially arrested Jan. 13. A plea agreement was in place and he was on release awaiting sentencing when he was arrested a second time Sept. 3 and charged with setting more fires while on release.

County Attorney Sam Vederman withdrew the plea agreement from the first arrest. Under a new plea agreement reached Jan. 4, Campbell pleaded guilty to one count of arson of a structure or property and burning of wildlands. The first count applied to his first arrest, while the second one applied to his later arrest.

All other charges against Campbell were dismissed.

At Campbell's sentencing, his attorney, Janet Sorrell of the La Paz County Public Defender's Office, asked Burke for leniency. She asked Burke to consider his age, the fact that he confessed to the crimes, and that he cooperated with law enforcement. She said there was a chance he could get the help he needed and he was young enough that he could repay his debt.

Vederman acknowledged Campbell confessed and cooperated with the authorities. However, he said this was the only positive thing to come out of this case. He said what Campbell did was dangerous and could have led to a disaster. He said Campbell should not receive a mitigated sentence.

In handing down his sentence, Burke said Campbell's confession and cooperation with authorities were mitigating factors on the first count, and he sentenced him to four years in prison.

On the second count, Burke said he saw no such mitigating factors and sentenced him to 7.5 years, the presumptive sentence for the charge. He noted Campbell was on release from his first arrest.

"You had a plea agreement in place," Burke said to Campbell. "You might have gotten just probation."

Due to the nature and the timing of the incidents, Burke said the sentences would be served consecutively.

The matter of restitution remained unresolved as Sorrell and Vederman had conflicting reports on the amount. A restitution hearing was set for 2:30 p.m. May 3.

The original charges covered fires that dated back to January 2008. La Paz County Sheriff's spokesman Lt. Linc Gilbert said the department began to investigate the fires after they received tips from the community and because there appeared to be too many fires for a community the size of Ehrenberg.

The second set of charges dates back to June 2009, and covers four structure fires, two brush fires, and two burglaries. A second defendant in the case, Hicks, was also arrested for setting more fires. The plea agreement in his case was also withdrawn.

" DEAR BOTH RATS. We are all over thirteen on here right. Seriously? We are from Arizona which is in the desert. Please do not try to tell us that you 'invented' the name desertrat when it is obviously a common term. Many people call themselves desertrats here in Parker andany many people have that as a nickname. To put some down because of the name chosen is childish. It shows the uneducated side, immature and pathetic side. Seriously? "

" Many of you are clueless yet you make uneducated comments.... Unless you are in the court room, you will not know if the CA's office pushed to keep someone in custody, or took no position on an OR release..... The majority of "serious cases" such as this, the CA's push for a bond or no bond....It is the Judge that decides if someone is released or not..Being a flight risk, or an immediate risk to the community are the 2 issues the court stews over to determine if one should be released or not.. As far as plea agreements, that is how our system in the USA works to move cases along, allowing the most serious cases that do not deserve a plea go to trial.... There have been more jail/prison sentences lately then the last 4 years combined coming out of La Paz County...Some of the CA's press releases are excellent about spreading the message to the felons in the community that this behavior is no longer acceptable here! " retired doesnt like the Judge? Shows what kind of man he is. Michael Burke has been around for years and is highly respected by all. Guess retired too busy protecting his VederWOman that any props to others is offensive. "

Lawman wrote on Feb 5, 2010 9:50 AM:

" Vederman is a joke to this County. Judge Burke is highly respected by everyone and I respect him for having to put up the County Attorney. He makes the right decisions when he has the chance to hear a case. If Vederfail hasn't already failed to prosecute or gave them a plea the honoarble Judge steps in and saves the case. These people behind bars aren't from the work of Notaman, they are from the work of our Judge. We should give the credit where credit is due. Thank you Judge Burke. "

DesertRat wrote on Feb 5, 2010 9:21 AM:

" Apparently the County Attorney pled with the FireLighters because it was in Erenberg? I guess he doesn't see that town as any property good worth saving from fires? It sickening. "

absinthe wrote on Feb 5, 2010 9:17 AM:

" Look like retired has a problem with people praising the Judge? The current Superior Court Judge is the best this County has ever been in front of him or has even had time to speak with him through the years hknows it. It is time to recall this current County Attorney, he is the worst this County has ever seen or had to deal with. I cannot believe he pled these Firestarters, the Crimes are so heinous. "

o'really wrote on Feb 5, 2010 9:00 AM:

" Heard Judge Burke was really knowledgable and exceptionally smart on the bench. Haven't heard the same aboutt he Vederman guy. LaPaz is lucky to have a Judge who can take the bull by the horns when the La Paz County Attorney is sittin on the chute gate. "

retired wrote on Feb 5, 2010 8:00 AM:

" wow, 1st two comments within 6 minutes attacking the CA and praising the judge. Looks like the work of one CA hater... just like all the other posts here on the Pioneer. "

" There comes a time in every man's life when you thank your lucky stars that someone was there to take up the slack. I salute you Judge Burke for perservance and obtaining greatness when those around you fall so short. "

Newbie wrote on Feb 3, 2010 12:51 PM:

" From reading this article it looks like the County Attorney Vederfail gave this guy plea agreement that would have just given this FIRESTARTER probation? Well, I can only assume all the other FIRESTARTERS got same plea deal. No wonder there wasn't an article about this in the paper before. It is now up to JUDGE BURKE to keep us safe, we now know how little the County Attorney is doing. "

Qtzitemom wrote on Feb 3, 2010 11:27 AM:

" It is very good to know that we have a smart Judge on the bench to take this felon off of our streets and keep us safe. I cannot believe that Vedermann gave this guy plea agreements. "

Bert wrote on Feb 3, 2010 11:21 AM:

" THANK you Judge BURKE!! Thank you for cleaning up the mess of the County Attorney's Office. "
